Privacy Policy

This Privacy Policy explains the nature, scope, and purpose of the collection and processing of personal information (“Data”) by Procedes LLC (“we,” “our,” “us”) when you use our websites, features, content, or external online presences (collectively, “Online Services”).

We are committed to complying with U.S. federal and state privacy laws (including the California Consumer Privacy Act/California Privacy Rights Act – CCPA/CPRA) and, where applicable, the EU General Data Protection Regulation (GDPR) and the UK GDPR.

2. Categories of Data Collected

We may collect and process the following types of data:
    •    Identifiers & Contact Data: names, postal addresses, email addresses, phone numbers.
    •    Account & Contract Data: services requested, project details, contract history, invoices.
    •    Payment Data: bank details, transaction history (processed via secure third parties).
    •    Content Data: text inputs, photographs, graphics, videos, uploaded files.
    •    Usage Data: pages visited, time of access, referring URLs, interactions.
    •    Device/Technical Data: IP addresses, browser types, operating system, device information.
    •    Marketing Data: preferences, newsletter sign-ups, interaction with campaigns.

We do not process sensitive categories of data (such as biometric, health, or political information).

Where GDPR applies, the following bases are used:
    •    Art. 6(1)(a) GDPR – Consent (e.g., marketing)
    •    Art. 6(1)(b) GDPR – Contract performance
    •    Art. 6(1)(c) GDPR – Legal obligations
    •    Art. 6(1)(f) GDPR – Legitimate interests (e.g., IT security, marketing analytics)

6. Sharing of Data

We may disclose data to:
    •    Service providers and processors (hosting, IT, analytics, email newsletter providers such as Mailchimp)
    •    Payment service providers (for secure processing of transactions)
    •    Business affiliates (e.g., Procedes Group entities in the EU, when required to fulfill services)

All processing agreements with service providers follow applicable U.S. and GDPR requirements (including Standard Contractual Clauses or EU–U.S. Data Privacy Framework for international transfers).

7. International Transfers

If data is transferred outside the U.S. or EU/EEA:
    •    For EU/UK residents, transfers are based on the EU–U.S. Data Privacy Framework (DPF) or Standard Contractual Clauses (SCCs).
    •    For all users, we ensure equivalent protections when data is processed by international third parties.

8. Security Measures

We implement appropriate technical and organizational measures (Art. 32 GDPR equivalent; “reasonable security measures” under U.S. law), including:
    •    SSL/TLS encryption
    •    Secure access controls
    •    Regular monitoring and updates
    •    Data minimization and access restrictions

9. Retention of Data

We retain data only as long as necessary:
    •    Contractual/business data: up to 7 years (U.S. tax law)
    •    Marketing data: until withdrawal of consent or inactivity
    •    Legal and accounting records: up to 10 years (where required)

After expiration, data is securely deleted or anonymized.

10. User Rights

U.S. Residents (e.g., California CCPA/CPRA):
    •    Right to know what data is collected and disclosed
    •    Right to request deletion
    •    Right to opt-out of the sale or sharing of data
    •    Right to non-discrimination for exercising these rights

EU/UK Residents (GDPR):

    •    Right to restriction (Art. 18 GDPR)

We use cookies and similar technologies for:

12. Analytics & Third-Party Services
    •    Google Analytics: used for website performance and visitor analysis (with IP anonymization enabled).
    •    Mailchimp: used for newsletter subscriptions and delivery.
    •    Social Media Integrations: LinkedIn, Instagram, and YouTube may collect usage data in line with their policies.

13. Newsletter
    •    Subscription is based on consent (double opt-in).
    •    Data processed: email address (and optionally name).
    •    Recipients may unsubscribe at any time.
    •    Tracking: newsletters may include pixels/web beacons to measure open and click rates (only used for aggregated reporting).

14. Children’s Privacy

We do not knowingly collect data from children under 16. If we become aware that such data has been collected, it will be deleted.

15. Changes to this Policy

We may update this Privacy Policy from time to time. Updates will be posted here with a revised “Effective Date.” Material changes may also be communicated via email or website notice.
